This Freelancing Services Agreement (this "Agreement"), between Luke Somerville Tattoo and the client, is dated and effective as of the date on which the acknowledges and agrees to the terms of this Agreement by booking the Services on the Site (each term as defined below).

1. Services Overview
Luke Somerville Tattoo agrees to provide the Client with a custom tattoo design. The design will be created based on the what was discussed during the initial consultation.

2. Service Fees

The Client will pay fees (the "Fees") at the rates specified on the Site at the time. The Fees paid for the design will not change in the event of the Luke Somerville Tattoo rate change, except as described in Section 3 below. No refunds will be provided once Client has paid. The payment will be made via this form, alt Bank Transfer or Paypal.

3. Changes to Service

The Client may request additional or different services directly from Luke Somerville Tattoo. Compensation for such additional services must be handled directly with Luke Somerville Tattoo.

4. Ownership and Use
4.1 Ownership: Luke Somerville Tattoo will retain all ownership rights to the design.

4.2 Use: Luke Somerville Tattoo grants the Client a non-exclusive license to use the design for personal use only. the Client may not sell or distribute the design without Luke Somerville Tattoo prior written consent.

5. Freelancer's Right to Decline to Process

5.1 Right to Decline: Luke Somerville Tattoo reserves the right to decline to proceed with the tattoo if, in their professional opinion, it is not a good fit. In such cases, Luke Somerville Tattoo will inform the Client.

5.2 Indemnification: the Client agrees to indemnify and hold harmless Luke Somerville Tattoo from any claims or damages arising from such refusal. Luke Somerville Tattoo decision to decline to proceed with the tattoo does not constitute a breach of this Agreement, and the agrees to release Freelancer from any liability arising from such refusal.

6. Client’s Obligations

The Client agrees to communicate promptly with the Luke Somerville Tattoo, confirming and notifying of any changes in a timely manner.

7. Confidentiality

The Client agrees to maintain the confidentiality of any information disclosed during the course of this Agreement. Confidential information includes, but is not limited to, proprietary business information, payment, structure of services, & contract.

8. Termination

Luke Somerville Tattoo may terminate this Agreement in the event of a breach by the Client. Termination shall be effective upon notice via email, and any outstanding fees or payments shall become immediately due.

9. Force Majeure
Luke Somerville Tattoo will not be liable for any delay or failure to perform their obligations under this Agreement due to events or circumstances beyond their reasonable control, including but not limited to illness, acts of God, natural disasters, acts of terrorism, or government actions.

BY BOOKING THE SERVICES AND ACCEPTING THE BOOKING, THE PARTIES HERETO EXPRESSLY ACKNOWLEDGE AND AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THE AGREEMENT, AND FURTHER ACKNOWLEDGE THAT THEY ARE LEGALLY COMPETENT TO ENTER INTO THIS AGREEMENT.
